Canada has been known for many years for its tradition to offer protection to people who have been forced to seek protection against persecution and danger in their homeland! The Figueroa Family is being affected by the immigration laws that have been adopted, by Section 34.1 of the I.R.P.A. to be specific.
This blog has been created with the objective to become a link among the community who still believe in Canada's Tradition and search for alternatives that would allow to make a difference for the defense of individual rights!

Analizando la Ley de Inmigración.
Sección 34.1 de la Ley de Inmigración y Refugio dice:
Seccion 34
(1) Un residente permanente o un extranjero es inadmisible por razones de seguridad por :
f) Ser Miembro de una Organización de la que se tiene Motivos Razonables para Creer es una Organización que se involucró, se involucra o involucrará en actos de terrorismo.
De acuerdo a las regulaciones de inmigración un oficial de la Agencia de Servicios de Aduana, debe interpretar la definición de Motivos Razonables para Creer, de la siguiente manera:
Si a dos personas razonables se les presentan los mismo hechos sobre un tema y ambos llegan a las mismas conclusiones : entonces se puede decir que hay Motivos Razonables para Creer que algo ha sucedido...
Ahora, a la Luz del Caso de Inmigración de Jose Figueroa. Consideremos 2 personas razonables: El ex-ministro de Asuntos Exteriores de Canada, y un Adjudicador de Inmigracion o un Agente de Aduanas... ambos han tenido acceso a la misma información con respecto al FMLN. Sin embargo ambos han llegado a conclusiones diferenctes.
Entonces el concepto de Motivos razonables para Creer queda derrotado... ya que en este ejemplo ambas instancias llegan a conclusiones diferente...
Podemos seguir mostrando muchos otros ejemplos en los cuales conceptos y definiciones legales no se aplican a la realidad concreta...
